Litigation and Disputes
Most litigation matters involve disputes about rights, obligations and most fundamentally, money. The disputes are played out in a bewildering variety of courts from Magistrates Courts to the High Court and various specialist Tribunals.
At Butcher Paull & Calder we can assist with the following areas:
- Competition & Consumer
- Corporations Act
- Debt Collections
- Property disputes
- Will & Estate disputes
- General commercial litigation
- Family law
- Criminal law
- Personal Injuries
Disputes can be a stressful part of the law. Experience shows that the vast majority of disputes settle, probably 95% to 97% depending on the Court and area of law. Of the matters that proceed to trial, many of the claimants will not do better that they could have achieved at mediation.
At Butcher Paull & Calder, our philosophy is to get on with the claim with the least delay, but promptly look to mediation and dispute resolution to settle.
Most of our clients are ordinary people rather than big incorporation and organisations. Therefore, as a matter of course we look carefully at three main issues in each case:
- Producing a speedy result
- Minimising legal costs to the client
- Producing a practical commercial outcome
